Conditions of use

1. Burnus provides trading partners/distributors (users) with online access to the Burnus image database via HTTP for Internet research purposes and to enable the download of image files in accordance with these conditions of use.
2. The image database may only be used as described in these conditions of use. No other conditions of use apply, even if Burnus does not explicitly preclude them.
3. Users may only use the database for the benefit of Burnus or for measures that will jointly benefit Burnus and the user and only for measures that Burnus has approved. Image files downloaded for the purpose approved by Burnus may not be used by the user in any way that might offend one's sense of decency.
4. Users of the image database are thus expressly forbidden to use the downloaded image files for purposes other than for the approved purpose. This means that users may not use the images for their own sole commercial, non-commercial, or political purposes or for the commercial, non-commercial, or political purposes of third parties; nor may users distribute and/or communicate the downloaded files for any purposes other than the intended purpose.
5. Burnus provides the image database for use with regard to its type and scope on the basis of current basic technical, legal, and commercial conditions for the Internet. Burnus's responsibility for data transfer ends once the data has been passed to the router of the access provider of Burnus.
6. Burnus grants the user access authorization for research in the image database and for downloading files from the database in accordance with these conditions of use and provides the user with a user name and password for this purpose. The user name and password must be kept secret. If it becomes possible for the image database to be used by third parties as a result of the culpable infringement of this secrecy clause on the part of the user, the user is liable to compensate Burnus for resulting damages. Should the user have reason to think that a third party may have acquired knowledge of his or her password, he or she must immediately inform Burnus of this fact.
7. The password allows the user to access the image data in order to carry out research in and to download image files from the image database only to the extent stated to the user by Burnus for the purpose of fulfilling the approved purpose as defined by Burnus alone. Moreover, the user is only permitted to download image files that are actually to be used for the approved purpose.
8. Burnus is not obliged to update and/or enhance the image database.
9. With regard to its relationship with the user, Burnus alone retains all proprietary rights of use and exploitation for the image database and the individual parts thereof.
10. Burnus created the content of the image database itself and, when compiling the data, took the utmost care and carried out random checks on accuracy and completeness. However, it is still possible that some information may be incorrect and/or incomplete. Burnus does not accept responsibility for the usability of the downloaded image files with regard to the approved purpose or purposes of the user.
11. Burnus is not liable for damages of any kind incurred by the user unless it can be proven that Burnus acted with deliberate intent or gross negligence.
